Our Site is hosted on Shopify Inc., which provides the e-commerce platform that enables us to sell our products and services to you.

By using this Site, you confirm that you are at least 18 years old or the age of majority in your jurisdiction, whichever is greater. If you are allowing a minor to use this Site, you accept full responsibility for their activity.

4. Orders and Payment

Order Acceptance
Your order constitutes an offer to purchase. We are not obligated to accept any order and may cancel orders at our discretion. A binding contract is formed only when you receive an order confirmation email from us.

Pricing
All prices are subject to change without notice. The price charged will be the price displayed at the time of your order. Prices do not include taxes or shipping costs, which will be calculated and displayed during checkout.

Payment
By submitting payment information, you confirm that you are authorized to use the payment method, that all information is accurate, and that sufficient funds are available. We are not responsible for any fees charged by your bank or card issuer.

5. Subscriptions and Automatic Renewal

If you purchase a subscription, you will be charged automatically on a recurring basis until you cancel. To avoid being charged for the next billing cycle, you must cancel at least 24 hours before your scheduled billing date.

To cancel, log into your account and manage your subscription settings. Cancellation requests received after your billing date will take effect the following billing period.

6. Shipping and Delivery

We will arrange shipment of your order as specified during checkout. Shipping dates are estimates only and are not guaranteed. Title and risk of loss transfer to you upon delivery to the carrier.

7. Refunds and Returns

We accept returns for unopened products purchased directly from herbies.co. To request a refund, email contact.nuvarun@gmail.com within 30 days of receiving your order.

Key Points
Products must be returned before a refund is processed. Once we receive and verify the product is unopened, we will process your refund within approximately 15 business days. Refunds will be credited to the original payment method.

Refund Limitations
To prevent abuse, we reserve the right to refuse refund requests from customers who have requested more than two refunds within a 12-month period.

8. Intellectual Property

All content on this Site, including text, graphics, logos, and images, is the property of Herbies or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or exploit any content without our prior written permission.

Violation of these rules may result in immediate termination of your access.

12. Disclaimer of Warranties

Our total liability to you shall not exceed the amount you paid to Herbies in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the minimum extent permitted by applicable law.

14. Indemnification

You agree to indemnify and hold harmless Herbies, its officers, employees, and agents from any claims, damages, or expenses arising from your breach of these Terms or violation of any law or third-party rights.

15. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Agreement to Arbitrate
You agree that any dispute arising from these Terms, our products, services, or marketing practices shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator shall apply Wyoming substantive law consistent with the Federal Arbitration Act.

No Class Actions
You agree to resolve disputes on an individual basis only. You waive the right to participate in class actions, class arbitrations, or representative proceedings.

Opt-Out Right
You may opt out of this arbitration agreement within 30 days of your first purchase by sending written notice to Unoriginal LLC, Attn: Legal Department, 3140 West Main Street, Riverton, Wyoming 82501, United States. Include your name, the product purchased, and your intent to opt out.

Exceptions
Herbies may seek injunctive relief in court for intellectual property disputes. Such claims shall be brought in the state or federal courts of Wyoming.

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.

17. Electronic Communications

By using this Site or providing your email address, you consent to receive electronic communications from us, including order confirmations, promotional messages, and updates. These communications satisfy any legal requirement that notices be in writing.

SMS/Text Messages

If you opt in to receive text messages, you consent to transactional and promotional messages from Herbies. Message frequency varies, and standard message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. We may share your information with service providers who help deliver these messages.

18. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, war, labor disputes, or supply chain disruptions.

19. General Provisions

Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Assignment
You may not assign your rights under these Terms without our written consent. Any unauthorized assignment is void.

No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Entire Agreement
These Terms, together with our Privacy Policy and Shipping Policy, constitute the entire agreement between you and Herbies regarding your use of the Site.
